CGS Terms and Conditions

Welcome to CGS! These Terms and Conditions ("Terms") govern your use of our website, services, and software. By accessing or using our services, you agree to comply with these Terms. If you do not agree, please refrain from using our services.
1.1 "CGS" refers to Creative Growth Solutions, including all subsidiaries, affiliates, directors, officers, and employees.
1.2 "User," "you," or "your" refers to the individual or business entity accessing our website or using our services.
1.3 "Services" refers to all consulting, SaaS, virtual assistance, automation, operational support, training, and business-related services offered by CGS.
1.4 "Content" includes all information, materials, templates, automation, software, and business strategies provided by CGS.
1.5 "Work Product" refers to any reports, automation workflows, standard operating procedures (SOPs), or other deliverables created by CGS for a client.
1.6 "SaaS" refers to Software-as-a-Service products or platforms provided by CGS for business operations, workflow automation, or optimization.
2.1 Eligibility
To use CGS services, you must be at least 18 years old or the legal age of majority in your jurisdiction.2.2 Scope of Services
CGS provides business automation, operational support, consulting, and SaaS tools designed to optimize efficiency.
CGS does NOT provide legal, financial, tax, or investment advice. Any insights shared are for business efficiency purposes only.
CGS is not responsible for ensuring legal or regulatory compliance unless explicitly included in a service agreement.
Results depend on execution—CGS provides strategies and tools, but implementation remains the client’s responsibility.2.3 Acceptable Use
You agree to use our services for lawful purposes only. Unauthorized activities such as hacking, data scraping, or misusing CGS tools for illegal purposes are strictly prohibited.2.4 Service Modifications
CGS reserves the right to modify, suspend, or discontinue any part of our services at any time.
3.1 Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.3.2 Accurate Information
Users must provide accurate, up-to-date information. CGS is not responsible for errors due to inaccurate data.
4.1 Fees & Billing
All services provided by CGS are paid up front unless a deferred payment or installment plan has been agreed to in writing.
Payment plans, if offered, must be explicitly documented and signed by both parties before service commencement.4.2 Subscription & Cancellation Policy
Subscriptions auto-renew unless canceled prior to the renewal date.
Clients may cancel at any time, but no refunds will be issued for the remaining period of a billing cycle.4.3 Service Suspension for Non-Payment
Failure to make timely payments will result in the immediate suspension of services until all outstanding fees and charges are paid in full.
Any late payments may be subject to additional charges or reactivation fees.
CGS reserves the right to permanently terminate access to services if unpaid balances remain outstanding beyond a reasonable period.4.4 Payment Terms & Updates
CGS reserves the right to modify payment terms and pricing structures at any time, with reasonable notice provided to clients and users.
Continued use of services after a pricing update constitutes acceptance of the revised terms.
5.1 Ownership of Work Product
Custom-built workflows, SOPs, and deliverables become the client’s property upon full payment.
CGS retains ownership of non-client-specific templates, software, and automation frameworks for future projects.5.2 Use of SaaS and Proprietary Tools
CGS SaaS platforms and tools are licensed on a non-transferable, limited-use basis.
Clients may not resell, modify, or distribute CGS software without written permission.5.3 AI-Generated & Automated Content Disclaimer
Some services use AI-generated content. CGS does not guarantee 100% accuracy of AI outputs, and clients must validate automated results before implementation.5.4 Data & Distribution Rights
If CGS powers the system, CGS retains full rights to the campaign infrastructure, delivery mechanisms, engagement flows, messaging architecture, and system logic.
Clients retain their contact list but acknowledge that CGS maintains ownership of digital pathways, tracking methods, and performance insights used or gathered during system execution.5.5 Future Contact Permission
CGS may re-engage with campaign recipients in the future, under CGS branding, for follow-up, feedback, or additional CGS-related offers. This right is stated transparently in our outreach terms and opt-in flows.
6.1 No Guarantees on Financial Outcomes
CGS does not guarantee revenue increases, profit growth, or specific financial results. Market conditions and execution are outside our control.6.2 Cost Savings & Time Efficiency Guarantee
CGS ensures measurable improvements in time efficiency and operational cost savings, but results vary based on client execution.6.3 Client Responsibility for Execution
Clients remain responsible for implementing CGS recommendations. CGS is not liable for poor execution or market-related losses.6.4 Service Downtime & Third-Party Integrations
CGS is not responsible for downtime caused by third-party integrations (e.g., CRMs, payment processors, software tools).
While CGS aims for uninterrupted service, occasional maintenance or updates may cause temporary unavailability.
7.1 Client Data Protection
CGS implements industry-standard security measures to protect client data.
Clients are responsible for maintaining security on their own devices and networks.7.2 Use of Anonymized Data for Improvement
CGS may collect anonymized data to improve services and develop benchmarking insights, but never shares client-specific or personal data externally.7.3 No Sale of User Data
CGS does not sell, rent, or trade any client data to third-party vendors or advertisers.
8.1 Termination by CGS
CGS may suspend or terminate services for non-payment, fraudulent activity, or violation of these Terms.8.2 Termination by Client
Clients may cancel subscriptions or services, but refunds are only issued if specified in a service agreement.
9.1 Mediation Before Legal Action
Clients must attempt mediation before initiating legal proceedings.9.2 Limitation on Claims
All legal claims must be filed within one (1) year of the dispute arising.
